ORDINANCE NO.  470

 

 

AN ORDINANCE PROVIDING FOR THE REPEAL OF ORDINANCE NO. 445;  ESTABLISHING WATER RATES, TAP FEES AND DEPOSITS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEALER CLAUSE.

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANITE SHOALS, TEXAS:

 

 

ARTICLE I – REPEAL OF PREVIOUS ORDINANCES:  This Ordinance hereby repeals and replaces Ordinance No. 445.

 

 

ARTICLE II – WATER RATES, TAP FEES AND DEPOSITS:

 

SECTION 1. Incorporation Of This Ordinance Into Customer Contract:  All of the provisions of this ordinance and Ordinance 310 and all amendments shall be deemed to be incorporated into every contract between the City Water Department and its customers, and each customer shall be charged with the responsibility for knowledge of the provisions of this ordinance, and by applying for and accepting water from the City Waterworks, to have assented to the provisions hereof.

 

SECTION 2. Water Rates:

 

(A) Residential and commercial customers shall be charged the minimum monthly rates per metered water connection as established in Table One for service within the corporate limits of the City and, for service outside the corporate limits of the City.  These charges are levied in accordance with the size of the meter serving the customer.

(B) The first 2,000 gallons of water are included in the minimum monthly charges shown in Table One.  Water usage above 2,000 gallons shall be billed at the following rates per 1,000 gallons:

(C)  The minimum fees shown in Table One shall be charged whether the customer actually uses the service or not.

 

(D) Minimum Monthly Base Charges for water service with a meter over 4 inches will be determined by the City Council on a case by case basis.

 

(E) Master Meter Minimum Base Charge, Number of Minimums to be Charged: Customers with a Master Meter will pay a Minimum Monthly Base Charge calculated as follows, water usage above the minimum shall be charged at the rate set forth:

 

  1. Apartment Buildings, Condominiums, Mobile Home Parks and Churches: Each unit or space available shall be considered an individual residence with no regard for the number of units or spaces actually occupied.  Each residence will pay the respective minimum and receive 2000 gallons of water.

 

  1. Recreational Vehicle Parks:  Each space available shall be considered 0.15 minimums with no regard for the number of spaces actually occupied.

 

  1. Hotels/Motels and Bed and Breakfasts’:  Every available rental room will be considered 0.50 minimums with no regard for the number of rooms actually occupied.

 

  1. Hospitals and Schools:  Every lavatory, toilet, urinal and shower bath shall be considered 0.10 minimums.

 

  1. Strip Shopping Centers, Restaurants and Convenience Stores:  Each business unit shall be charged the minimum monthly charge.

 

  1. Malls and Office Buildings:  Every lavatory, toilet, urinal and shower bath shall be considered 0.10 minimums.

 

  1. New Construction and Remodeling (unoccupied):  Shall be considered to be one minimum for water.

 

  1. Other (not listed above):  To be established on a case by case basis by the City Council.

 

NOTE:  In all of the above cases, the total units will be rounded up to the next whole number.  All minimums are at the rate listed in Table One.

 

SECTION 3. Tap Fees:

 

The tap fees (or connection fees) shown in Table Two shall be charged to each user connecting to the water system of the City.  These fees are applicable only where the existing main is larger than the requested meter size.  These fees are non-refundable.  When water meter size is equal to or larger than existing water main an application for service must be made to the Building Inspector and submitted to the City Council for consideration of additional charges.

(C) Tap Fees for water service with a meter over 4 inches will be determined by the City Council on an individual, case by case basis.

 

SECTION 4. Late Charges: Any bill which is not paid by the tenth (10th) day of the month following its rendering to the user, shall have added to it a Late Charge of TEN DOLLARS ($10.00).

 

SECTION 5. Reconnect Fee:

 

(A) Reconnect Fee – When service has been disconnected due to non payment of bill:

 

(1)   One-time reconnection within a 12 month period: $40.00

(2)   Second-time reconnection within a 12 month period: $60.00

(3)   Third-time reconnection within a 12 month period, and each additional reconnect within a 12 month period: $70.00

 

(B) A reconnect fee (or turn on fee) will be charged any time the Water Department is called to restore the water service of a customer requesting Seasonal Service.  This fee shall be FORTY DOLLARS ($40.00).

 

(C) Temporary Reconnect three (3) days of water, limited to 2,000 gallons.  A fee of TWENTY-FIVE DOLLARS ($25.00) will be charged for residents inside the corporate limits of the City.  A fee of FORTY-FIVE DOLLARS ($45.00) will be charged for residents outside the corporate limits of the City.

 

SECTION 6. Utility Deposits: At the time of making application for water service, the applicant shall pay a deposit to the City Water Department as follows:

 

A) ONE HUNDRED TWENTY-FIVE DOLLARS ($125.00) for residential water service inside the corporate City limits.

 

(B) ONE HUNDRED SEVENTY-FIVE ($175.00) for residential water service outside the corporate City limits.

 

C) For Commercial customers, the following deposit shall be required:

 

            METER SIZE

 

            2 inch meter               $350.00

            3 inch meter               $450.00

            4 inch meter               $650.00

 

(D) Deposits for water service with a meter over 4 inches will be determined by the City Council on an individual, case by case basis.

 

Section 7. Hose Bibb Vacuum Breakers: New water connections will be inspected and must be brought up to Plumbing Code.  Hose Bibb Vacuum Breakers will be placed on all outside faucets, with a fee of $5.00 per faucet.  This fee will be added to the Water Bill.

 

 

ARTICLE III SEVERABILITY: Should any word, phrase, sentence, paragraph or portion of this ordinance be determined by a court of competent jurisdiction to be invalid for any reason then in that event such invalidity shall not affect the remaining portions of the ordinance.

 

 

ARTICLE IV EFFECTIVE DATE: This ordinance shall become effective upon passage, adoption and publication in accordance with state law.

 

 

ARTICLE V REPEALER: All Ordinances inconsistent with this ordinance are hereby repealed.
