RESOLUTION NUMBER 336

 

 

A RESOLUTION OF THE CITY COUNCIL OF GRANITE SHOALS ESTABLISHING A MUNICIPAL ANNEXATION PLAN.

 

 

WHEREAS, the City of Granite Shoals, Texas is a Home Rule municipality located in Burnet County, created in accordance with the provisions of the Texas Constitution and the Texas Local Government Code; and

 

WHEREAS, Chapter 43 of the Local Government Code establishes the requirements and procedures for municipal annexation, and

 

WHEREAS, on November 12, 2001, the City Council adopted Resolution Number 241, which provided that the city’s annexation plan was to only annex areas that were statutorily exempt from being included in an annexation plan; and

 

WHEREAS, the City of Granite Shoals desires to annex areas that may be required to be in an annexation plan; and

 

WHEREAS, the Comprehensive Plan outlines areas of proposed municipal annexation and the City’s Planning and Zoning Commission has concluded that any territory included in the Comprehensive Plan that is not exempt from state law annexation plan requirements should be included in the City’s Municipal Annexation Plan.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRANITE SHOALS:

 

SECTION 1.   MUNICIPAL ANNEXATION PLAN.  The City of Granite Shoals intends to annex areas in its extraterritorial jurisdiction and identified in the City of Granite Shoals’ Comprehensive Plan, as shown in attached Exhibit A.  Chapter 43.056 of the Local Government Code provides the requirements and exemptions to the municipal annexation plan.

 
SECTION 2.  AREAS TO BE INCLUDED IN THE ANNEXATION PLAN.  The areas identified below are included in the annexation plan:
 
The Sherwood Shores IV and Kingswood subdivisions in Burnet County, Texas.
 
SECTION 3.  PROPERTY EXEMPT BY STATE LAW FROM ANNEXATION PLAN REQUIREMENTS.  To the extent that this annexation plan identifies territory that falls within an exception under state law that permits a city to annex territory without placing such territory in an annexation plan, or to the extent that territory is not included within this plan, the City
reserves the right to annex such territory at any time pursuant to any applicable state law exception.  
 
SECTION 4.  PUBLICATION.  This annexation plan shall be posted and maintained on the city’s Internet web site as required by Section 43.052(j), Local Government Code.
