ORDINANCE NO. 399
AN ORDINANCE OF THE CITY OF GRANITE SHOALS, TEXAS, ESTABLISHING THE OFFICES OF PRESIDING ELECTION JUDGE AND ALTERNATE PRESIDING JUDGE; DESIGNATING A SINGLE PRECINCT FOR THE CITY OFFICERS’ ELECTION FOR 2004; ESTABLISHING A POLLING PLACE; SETTING THE HOURS FOR SAID ELECTION; PROVIDING FOR COMPENSATION; ESTABLISHING RULES RELATED TO EARLY VOTING; PROVIDING FOR NOTICE OF ELECTION; PROVIDING FOR ELECTION RETURNS; REQUIRING THAT A WRIT OF ELECTION BE SERVED UPON THE PRESIDING ELECTION JUDGE; AND PROVIDING FOR SEVERABILITY.
WHEREAS, The Mayor of the City of Granite Shoals, Texas, in Order of Election, has ordered that a municipal election be held in the City of Granite Shoals on the 15th day of May, 2004, for the purpose of electing the following officers: One (1) Mayor and (3) Aldermen at (2) year terms, all of which are positions of the City Council of the City of Granite Shoals, Texas: NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANITE SHOALS, TEXAS:
PART 1: Election Judges.
1.1 There are hereby established the offices of: (1) Presiding Election Judge and (2) Alternate Presiding Judge of the City of Granite Shoals to serve at the Municipal Election of the City of Granite Shoals to be held on May 15, 2004.
1.2 The Presiding Election Judge for this section shall be in charge of, and responsible for, the management and conduct of the election at the polling place for the City’s election precinct.
1.3 The City Council of the City of Granite Shoals shall, by written order, appoint the Presiding Election Judge and the Alternate Presiding Judge.
1.4 No person shall be appointed, or serve as Presiding Election Judge or Alternate Presiding Judge at an election who:
(1) is not a qualified voter of the City of Granite Shoals; or
(2) holds an elective public office; or
(3) is a candidate for public office in an election held on the same day; or
(4) is employed by , or related within the second degree of consanguinity of affinity to, an opposed candidate for a public office in the election; or
(5) is the campaign treasurer or assistance campaign treasurer to an unopposed candidate for public office in the election.
1.5 The appointment of the Presiding Election Judge and the Alternate Presiding Judge is for a single election of City Officers to be held on May 15, 2004.
1.6 The Presiding Election Judge and Alternate Presiding Judge shall each be given written notice of their appointments by delivery thereof by the City Secretary not later than the 20th day after the date the appointments are made. Said appointment will also include the Presiding Election Judge and Alternate Presiding Election Judge to be in Charge of, and responsible for, the management and conduct of the Early Voting Ballot Board.
1.7 A vacancy in the office of a Presiding Election Judge or an Alternate Presiding Judge shall be filled by the City Council. However;
(1) If neither the Presiding Election Judge not the Alternate Presiding Judge can serve in an election, and their inability to serve is discovered so late that it is impracticable to fill the vacancies by appointment by the City Council, the Mayor shall appoint a replacement Presiding Election Judge to preside at the election.
(2) If neither the Presiding Election Judge, the Atlernate Presiding Judge, nor the replacement Presiding Election Judge are present at the polling place at the time for opening the polls, upon receiving information of such absences, the Mayor, or his duly authorized representative, shall investigate the absences and appoint a replacement Presiding Election Judge, unless the Mayor learns that a previously appointed replacement Presiding Election Judge will immediately report for duty.
PART 2: Precinct.
The City of Granite Shoals is hereby designated as a single precinct for the purpose of the Municipal Election.
PART 3: Polls. 3.1 That said election shall be held at the City Hall located at 410 N. Phillips Ranch Road in said City.
3.2 On election day the polls shall be open from 7:00 o’clock A.M. to 7:00 o’clock P.M.
PART 4: Election Clerks.
4.1 The Presiding Election Judge shall appoint the necessary clerks to assist said Judge, which shall not exceed four (4), nor be less two (2) clerks.
4.2 No person shall be appointed or serve as an election clerk who:
(1) is not a qualified voter of the City of Granite Shoals; or
(2) holds an elective public office; or
(3) is a candidate for public office in an election held the same day; or
(4) is employed by, or related within the second degree of consanguinity or affinity to, an opposed candidate for a public office in the election; or
(5) is the campaign treasurer or assistance campaign treasurer to an opposed candidate for a public office in the election.
PART 5: Compensation.
The election judges and clerks shall be compensated for services rendered at a precinct polling place at a rate of $8.00 per hour.
PART 6: Early Voting.
The City Secretary shall serve as the early voting clerk. Early voting by personal appearance shall be held at the Granite Shoals City Hall, 410 N. Phillips Ranch Road. Early voting by personal appearance shall be conducted on the weekdays of the early voting period and during the hours that the City Secretary’s main business office is regularly open for business, beginning on the 17th day and continuing through the 3rd day preceding the date of said election. The above described place for early voting is also the early voting clerk’s mailing address to which ballot applications and ballots voted by mail shall be sent.
PART 7: Notice.
Notice of said election will be given in accordance with the terms of Texas Election Code Section 4.003 (a) (1) (b). The Mayor shall be responsible for the posting and publication of a Notice of Election in accordance with the provisions of said section.
PART 8: Election Returns.
Immediately after said election is held, the election judges holding the election shall make returns of the result thereof to the Mayor of this City, as required by the Election Code of this State.
PART 9: Severability.
If any provisions, section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to any person unconstitutional, void or invalid, the validity of the remaining portions of this ordinance shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion hereof, or provisions of regulations contained herein, shall become inoperative or fail by reason of any unconstitutionality of any other portion hereof, and all provisions of this ordinance are declared to be severable for that purpose.
PASSED by the City Council of the City of Granite Shoals at a meeting on the ___10th____ day of February , 2004, at which a quorum was present and for which due notice was given pursuant to Gov. Code 323.007 et.seq. (Vernon 1999).
